SUMMARY
Objetivo: Analisar a legalidade, abrangência, limites, legitimidade e fundamentalidade do ativismo judicial tanto quanto no dumping social, à medida que para eficácia plena dos direitos fundamentais, ou seja, tanto na esfera vertical como horizontal, são necessários esforços sem medida.Metodologia: Se utiliza do método hipotético dedutivo, da revisão bibliográfica, do direito comparado e da análise econômica constitucional do direito do trabalho.Resultados: Demonstra-se a relevância do ativismo judicial como instrumento transformador do Estado Democrático e Social de Direito, tanto quanto como meio de refutação da prática de dumping social.Contribuições: A fundamentalidade do ativismo judicial para o combate ao dumping social, vez que inevitalmente ante a inércia dos Poderes Executivo e Legislativo, tanto quanto a necessidade de conceder a concretização dos direitos e garantias constitucionais, impõe-se ao Poder Judiciário atender a totalidade dos anseios e transformações sociais, especialmente na perspectiva do Estado Democrático e Social de Direito.Palavras chaves: Ativismo Judicial. ABSTRACTObjective: Analyzing the legality, scope, limits, legitimacy and fundamentality of judicial activism as well as social dumping, as for the full effectiveness of fundamental rights, that is, both in the vertical and horizontal spheres, unlimited efforts are necessary.Methodology: It uses the hypothetical deductive method, bibliographic review, comparative law and constitutional economic analysis of labor law.Results: It demonstrates the relevance of judicial activism as a transforming instrument of the Democratic and Social State of Law, as well as a means of refuting the practice of social dumping.Contributions: The fundamentality of judicial activism to combat social dumping, since inevitably, faced with the inertia of the Executive and Legislative Powers, as well as the need to grant the realization of constitutional rights and guarantees, it is imperative that the Judiciary meet all the aspirations and social transformations, especially in the perspective of the Democratic and Social Rule of Law.Keywords: Judicial Activism.
