SUMMARY
Objetivo: O objetivo deste artigo é analisar as origens e os conceitos da Justiça Restaurativa, ora implantada pelo Conselho Nacional de Justiça e seus impactos nos direitos fundamentais, e, à luz da teoria sociológica da pós-modernidade, vislumbra alguns desafios que devem ser observados pelos operadores do direito, para que sejam traçadas estratégias, com o objetivo de lograr êxito na formação de uma rede de garantia de direitos e obter mobilização social.Metodologia: A pesquisa foi desenvolvida pelo método dedutivo com abordagem da criminologia desenvolvida na crítica do controle penal e da interdisciplinaridade, e a técnica foi da pesquisa bibliográfica, legislação e em sites eletrônicos.Resultados: O texto mostra que para o sucesso de implantação da Política Nacional de Justiça Restaurativa é indispensável um diálogo entre a dogmática e a zetética jurídica, e que para lograr êxito no adequado tratamento dos conflitos, é necessário reconhecer a lide sociológica e as características da sociedade contemporânea.Contribuições: As contribuições do estudo indicam que para o êxito da implantação da Política Nacional de Justiça Restaurativa, regulada pela Resolução nº 225/2016 do Conselho Nacional de Justiça, é indispensável conhecer os aspectos da sociedade pós-moderna, e adotar determinadas estratégias para obter o engajamento social exigido pelas práticas restaurativas.Palavras-chave: Direitos Fundamentais; Justiça Restaurativa; Modernidade; Burocracia; Lide sociológica.ABSTRACTObjective: The objective of this article is to analyze the origins and concepts of Restorative Justice, now implemented by the National Council of Justice and its impacts on fundamental rights, and, in the light of the sociological theory of postmodernity, it glimpses some hidden challenges that must be addressed. observed by legal practitioners, so that strategies can be drawn up, with the objective of achieving success in the formation of a network to guarantee rights and obtain social mobilization.Methodology: The research was developed by the deductive method with a criminology approach developed in the critique of criminal control and interdisciplinarity, and the technique was of bibliographic research, legislation and on electronic sites.Results: The text shows that for the successful implementation of the National Restorative Justice Policy, a dialogue between dogmatics and legal zetetics is essential, and that in order to succeed in the adequate treatment of conflicts, it is necessary to recognize the sociological struggle and the characteristics of the contemporary society.Contributions: The contributions of the study indicate that for the successful implementation of the National Policy on Restorative Justice, regulated by Resolution No. 225/2016 of the National Council of Justice, it is essential to know the aspects of postmodern society, and to adopt certain strategies to obtain the social engagement required by restorative practices.Keywords: Fundamental Rights; Restorative Justic; Modernity; Bureaucracy; Sociological lead.
