SUMMARY
RESUMOObjetivos: O presente trabalho apresenta uma análise das decisões do Supremo Tribunal Federal (STF) no âmbito dos direitos humanos durante os três primeiros meses oficiais de estado de calamidade no país devido à Covid-19.Metodologia: A metodologia adotada para a consecução deste trabalho englobou a pesquisa documental, bibliográfica e jurisprudencial, realizada em livros, periódicos, e na doutrina nacional e internacional, com o suporte da internet.Resultados: Constatou-se que, em relação à elaboração de atos normativos para conter o avanço da doença, houve atenção para proteção dos direitos humanos pesquisados. O direito social ao trabalho, à informação, direito à privacidade foram os primeiros a necessitarem de amparo do STF durante o estado de calamidade, tendo sido objetos de medidas provisórias. Evidenciou-se que o STF, de modo geral, emitiu decisões alinhadas à tutela dos direitos humanos.Contribuições: Expõem-se o cenário ocasionado pelo novo coronavírus, a evolução no Brasil, bem como as diretrizes internacionais sobre o assunto – notadamente as da Organização Mundial de Saúde (OMS). Após, sumariza-se as políticas de enfrentamento da Covid-19 pelos poderes Executivo e Legislativo desde o início do ano de 2020 até a declaração do estado de calamidade no país. Finalmente, discorre-se sobre as decisões do Poder Judiciário envolvendo direitos humanos durante os três primeiros meses da pandemia.Palavras-chave: Direitos Humanos; Covid-19; Supremo Tribunal Federal; Decisões; Constituição Federal. ABSTRACTObjective: The present paper presents an analysis of the decisions of the Supreme Court (STF) in the field of human rights during the first three official months of state of calamity in the country due to Covid-19.Methodology: The methodology adopted for the achievement of this work included documentary, bibliographic and jurisprudential research, carried out in books, periodicals, and in national and international doctrine, with the support of the Internet.Results: It was found that, in relation to the elaboration of normative acts to contain the advance of the disease, there was attention to protect the human rights researched. The social right to work, information, right to privacy were the first to require support from the Supreme Court during the state of calamity, having been subject to provisional measures. It was evidenced that the Supreme Court, in general, issued decisions aligned with the protection of human rights.Contributions: The scenario caused by the new coronavirus, the evolution in Brazil, as well as the international guidelines on the subject – nodits of the World Health Organization (WHO), are exposed. Then, the policies of confrontation of Covid-19 by the executive and legislative branches from the beginning of 2020 to the declaration of the state of calamity in the country are summarized. Finally, there is talk about the decisions of the judiciary involving human rights during the first three months of the pandemic.Keywords: Human rights; Covid-19; Supreme Federal Court; Decisions; Federal Constitution.
