Aceito em 08 de março de 2016.DOI: 10.12957/rdc.2016.19516ResumenEl objeto de este artículo, de carácter analítico e interpretativo, es examinar los problemas que opone el actual régimen mundial de la propiedad intelectual a la satisfacción material del derecho humano universal al conocimiento y al progreso científico y a sus aplicaciones. La hegemonía ideológica y política alcanzada por el neoliberalismo desde la década de los 80 del siglo XX en la práctica totalidad del mundo ha supuesto un debilitamiento de los ya frágiles Derechos Económicos, Sociales y Culturales (en los que se integra el derecho al conocimiento) y una expansión y reforzamiento de algunos Derechos Civiles, particularmente el derecho a la propiedad privada y en especial el derecho a la propiedad intelectual. El programa general de mercantilización que caracteriza tal ideología se ha aplicado con gran intensidad a la producción, distribución y orientación del desarrollo del conocimiento científico y de sus aplicaciones. Ello hace cada vez más difícil que, en una situación de creciente desigualdad socioeconómica, las mayorías sociales carentes de los recursos económicos y de las capacidades necesarias puedan satisfacer tal derecho humano universalAbstractThe aim of this paper, characterized by its analytical and interpretative approach, is to analyse the problems that the current global intellectual property regime poses to the material satisfaction of the universal human right to enjoy the benefits of knowledge, scientific progress and its applications. The ideological and political hegemony achieved by neoliberalism since the 80s of the twentieth century nearly all over the world, has weakened the already fragile Economic, Social and Cultural Rights in which the right to knowledge is integrated. This politico-ideological program has also expanded and strengthened some Civil Rights, in particular the right to private property and especially the intellectual property right. Further, the overall program of commodification that characterizes this ideology has been intensively applied to the production, distribution and orientation of the scientific knowledge development and its applications. Thus, in a situation where social and economic inequality is continuously growing, neoliberal politics makes harder for social majorities lacking of economic resources and basic capabilities to exercise this universal human right.Keywords: Human Rights, neoliberalism, intellectual property, commodification, social inequality, commons.
