SUMMARY
Objetivo: O papel contra hegemônico dos movimentos LGBTQIA+ na luta pelo reconhecimento e efetivação de um direito não-oficial à livre expressão das sexualidades minoritárias.Metodologia: Pesquisa bibliográfica narrativa, de abordagem qualitativa e de caráter descritivo-explicativo.Resultados: Constatou-se o desinteresse e a consequente inércia estatal, sobretudo da atividade legislativa perante a criação de normas jurídicas que atendam integralmente as demandas das minorias sexuais. Ainda, demonstrou-se que, por ser uma condição inata ao ser humano e indissociável de sua personalidade, a expressão sexual minoritária é uma necessidade básica e merece o respaldo normativo para a sua justa satisfação. Para tanto, os movimentos LGBTQIA+ demonstraram-se verdadeiros centros de produção normativa emergentes aptos a garantirem o devido amparo às questões de orientação sexual e identidade de gênero que fogem dos padrões heterocisnormativos.Contribuições: O estudo traz como contribuição a investigação do pluralismo jurídico do tipo comunitário participativo como uma alternativa legitimadora das práticas não-estatais, até então, desamparadas pelo Direito oficial manifestado na figura e atuação do Estado. De igual forma, a exploração da possibilidade do reconhecimento normativo não-convencional da liberdade de expressão sexual minoritária enquanto uma necessidade fundamental humana.Palavras-chave: Expressões sexuais minoritárias; Movimentos LGBTQIA+; Pluralismo Jurídico; Reconhecimento Jurídico; Sujeitos Coletivos de Direitos.ABSTRACTObjetive: This article analyzes the counter-hegemonic role of the LGBTQIA+ movements in the struggle for the recognition and realization of an unofficial right to free expression of minority sexualities.Methodology: narrative bibliographic research, with a qualitative approach and descriptive-explanatory character.Results: The lack of interest and the consequent inertia of the state was found, especially of the legislative activity towards the creation of legal norms that fully meet the demands of sexual minorities. Furthermore, it was demonstrated that, as an innate condition of human beings and inseparable from their personality, minority sexual expression is a basic need and deserves normative support for its just satisfaction. In its final part, It was noticed that the LGBTQIA+ movements proved to be true emerging normative production centers capable of guaranteeing due support to issues of sexual orientation and gender identity that escape from heterocisnormative standards.Contributions: The study brings as a contribution the investigation of legal pluralism of the participatory community type as an alternative legitimizing non-state practice, until then, forlorn by official law manifested in the figure and performance of the State. Similarly, the exploration of the possibility of unconventional normative recognition of minority sexual freedom of expression as a fundamental human need.
