A proposta deste artigo é analisar como o gênero aparece no discurso da jurisprudência da Corte Constitucional brasileira. A partir de um levantamento dos acórdãos que mencionam a palavra “gênero”, 24 decisões foram encontradas e seus votos foram examinados, à luz da teoria da performatividade, para tentar responder à pergunta. Três empregos principais foram destacados e os trechos foram separados e examinados de acordo com uma categorização desse uso (sexo e gênero; gênero masculino e feminino e identidade de gênero). Ao fim, uma análise sobre a produção normativa do gênero e a produção da relação entre ideal e cópia como produção da matriz heteronormativa de gênero é identificada no discurso examinado.Palavras-chave: gênero; performatividade; votos; Supremo Tribunal Federal.AbstractWhat do the Supreme Court Judges talk about when they talk about gender? The purpose of this article is to analyze how gender appears in the Brazilian Constitutional Court jurisprudence discourse. Based on a survey of judgments that mention the word "gender", 24 decisions were found and their sentences were examined, under the theory of performativity, in order to try to answer the question. Three main uses were highlighted and the excerpts were separated and examined according to a categorization of this usage (sex and gender; male and female gender and gender identity). In the end, an analysis of the normative production of gender and the production of relations between ideal and copy as a production of the heteronormative gender matrix is identified in the discourse examined.Keywords: gender; performativity; sentences; Federal Supreme Court.
