SUMMARY
Objetivo: o presente artigo aborda as moedas virtuais não governamentais, em especial o Bitcoin, dentro do contexto econômico, social e regulatório próprio da Sociedade da Informação que, dentre outros fenômenos, possibilita o surgimento de novas formas e modelos de circulação de riqueza.Metodologia: o texto constitui numa análise qualitativa de doutrina e legislação, com resultados obtidos pelo método indutivo.Resultados: o anonimato proporcionado pelos sistemas utilizados pelas criptomoedas pode incentivar a prática de delitos como a lavagem de dinheiro, sonegação fiscal, comércio de drogas, venda ilegal de armas e outros, o que levou alguns países a editar normas acerca da utilização das criptomoedas. O problema da regulação reside no fato de ser tecnicamente muito complexo identificar tanto a posse quanto as operações levadas a efeito por meio desse tipo de ativo, havendo inclusive quem afirme não existir tal possibilidade, ao menos com os meios e a tecnologia atualmente disponíveis.Contribuições: além da abordagem histórico-evolutiva do tema central, o texto enfrenta questões como o conceito de moeda; as relações econômicas na era informacional, com as crescentes transações de moedas virtuais em redes eletrônicas; a segurança jurídica; a regulação por uma autoridade monetária para coibir o financiamento de atividades ilegais, lavagem de dinheiro ou possível instabilidade financeira na economia e os limites técnicos que desafiam a eficácia desse tipo de regulação.Palavras-chave: Bitcoin; Moedas Virtuais; Transações Eletrônicas; Internet; Sociedade da Informação. ABSTRATCTObjective: this paper deals with non-governmental virtual currencies, especially the Bitcoin, within the economic, social and regulatory context of the Information Society, which, among other phenomena, enables the emergence of new forms and models of wealth circulation.Methodology: the text constitutes a qualitative analysis of doctrine and legislation, with results obtained by the inductive method.Results: the anonymity provided by the systems used by cryptocurrencies can encourage the practice of crimes such as money laundering, tax evasion, drug trade, illegal sale of arms and others, which has led some countries to issue regulations on the use of cryptocurrencies. The problem with regulation lies in the fact that it is technically very complex to identify both ownership and operations carried out through this type of asset, and there are even those who claim that such a possibility does not exist, at least with the means and technology currently available.Contributions: in addition to the historical-evolutionary approach of the central theme, the text addresses issues such as the concept of currency; the economic relations in the informational era, with the increasing transactions of virtual currencies in electronic networks; the legal security; monitoring and regulation by a monetary authority to curb the financing of illegal activities, money laundering or possible financial instability in the economy and the technical limits that challenge the effectiveness of this type of regulation.
