SUMMARY
RESUMOObjetivo: A temática do texto objetiva pensar a performatividade da transmigração feminina a partir do elemento identitário de gênero, para compreender o impacto da dinâmica transmigratória para as mulheres no contexto do direito à saúde. Nesse sentido, busca-se analisar o fenômeno da feminização das transmigrações que articula uma diáspora de precariedade ao longo do percurso transmigratório, fragmentando a potência existencial feminina e cambiando identidades; abordando-se também (in)efetivação do direito humano à saúde das mulheres transmigrantes no Brasil sob as lentes da Metateoria do Direito Fraterno.Metodologia: A presente pesquisa se pauta no método hipotético-dedutivo e é instruída por uma análise bibliográfica, sob a perspectiva da metateoria do direito fraterno, base teórica desenvolvida pelo jurista italiano Eligio Resta.Resultados: Constata-se que a fraternidade se consolida como uma possibilidade, um desafio e uma aposta de desconstruir, performaticamente, a vida precária das mulheres transmigrantes rumo à efetivação do direito à saúde e, consequentemente, dos Direitos Humanos.Contribuições: As contribuições desta pesquisa residem na possibilidade de refletir-se e indagar-se, diante da intersecção entre saúde, gênero e fraternidade, sobre a precarização da existência feminina das mulheres transmigrantes no Brasil, vislumbrando a possibilidade de reconhecimento do Outro (feminizado), numa dimensão de alteridade através da fraternidade. ABSTRACTObjective: The theme of the text aims to think about the performativity of female transmigration from the element of gender identity, in order to understand the impact of the transmigratory dynamic for women in the context of the right to health. In this sense, it seeks to analyze the phenomenon of the feminization of transmigrations that articulates a diaspora of precariousness along the transmigratory path, fragmenting the female existential power and changing identities; also approaching the (in)effectiveness of the human right to health of transmigrant women in Brazil through the lens of the Metatheory of Fraternal Law. Methodology: This research is based on the hypothetical-deductive method and is guided by a bibliographical analysis, under the perspective of the meta-theory of fraternal law, theoretical basis developed by the Italian jurist Eligio Resta. Results: It appears that fraternity is consolidated as a possibility, a challenge and a bet to performatically deconstruct the precarious life of transmigrant women towards the realization of the right to health and, consequently, to Human Rights.Contributions: The contributions of this research lie in the possibility of reflecting and questioning, given the intersection between health, gender and fraternity, about the precariousness of the female existence of transmigrant women in Brazil, envisioning the possibility of recognizing the Other (feminized) , in a dimension of alterity through fraternity.
