SUMMARY
RESUMOO presente trabalho pretende abordar as relações estruturais que, contemporaneamente, têm se estabelecido entre os sistemas religioso jurídico, através da interseção de regras e recursos entre eles. O objetivo central do trabalho é a busca de um sentido democrático para o direito à liberdade religiosa constitucionalmente adequado. Foi utilizado o método dialético, segundo a famosa tríade: tese, antítese e síntese. Os resultados iniciais apontam que os acoplamentos positivadas no sistema norte-americano são antidemocráticos, ao passo que as perspectivas hermenêuticas brasileiras são totalmente opostas, pois consolidam a democracia naquilo que depende do direito à liberdade religiosa.Palavras-chave: sistema jurídico, sistema religioso, acoplamentos estruturais, fundamentalismos, normatizaçõesABSTRACTThe present work intends to approach the structural relations that, contemporaneously, have been established between the religious and juridical systems, through the intersection of rules and resources between them. The main objective of the work is the search for a democratic sense for the constitutionally adequate right to religious freedom. The dialectical method was used, according to the famous triad: thesis, antithesis and synthesis. The initial results indicate that the couplings positive in the American system are antidemocratic, whereas the Brazilian hermeneutical perspectives are opposite, since they consolidate democracy in what depends the right to religious freedom.Keywords: legal system, religious system, structural couplings, fundamentalisms, normatizations.DOI: 10.7764/RLDR.8.93
