Characteristics of A Notary Deed For Transactions Through Electronic Media

Businesspeople who would indirectly benefit from these technical advancements have undergone significant adjustments. The responsibilities and implementation of the Notary as a public authority with the power to perform real deeds will change due to this evolution. Globalization and information technology advancements have caused a new dynamic in society, requiring Notary services to carry out ongoing legal operations, which is made possible by today’s information technology. However, the lack of legal tools that safeguard and govern Notaries in doing these tasks continues to be a barrier for them. The Notary profession faces a challenge in adapting to the globalization of information technology because their responsibilities as public servants change with the times. This study has a statutory approach and is normative in nature. According to the findings of this study, a third party known as the Certification Authority is required for the Notary Public to safeguard and certify documents for use in electronic transactions. The notarized deed that will be used is still a real document with full weight in court. Even yet, imagine that the party is not involved in the process. Even when the Notary prepared and signed the document directly or digitally, the Notary deed is still considered an unauthorized document and has the authority to prove that it was.
