SUMMARY
El principio de Iura Novit Curia es uno de los principios fundamentales dentro del derecho procesal que se aplican en la actualidad, pues, su significado es relevante al decir: “el juez conoce el derecho”. Dicho principio se basa en la aplicación realizada por el administrador de justicia, de las normas que, no necesariamente han sido invocadas por las partes procesales en función de los acontecimientos expuestos, pero que, el juez necesita aplicar un contenido normativo que le permita motivar y fundamentar su decisión. El objetivo general que se plantea en este artículo es Realizar un análisis crítico-jurídico del principio de Iura Novit Curia en materia laboral, el mismo que, se encuentra regulado dentro del ordenamiento jurídico ecuatoriano y tiene relevancia a nivel internacional. Para conocer el resultado investigativo se ha empleó la metodología cualitativa con métodos tales como el histórico lógico, determinándose la trayectoria real del principio de iura novit curia y cuáles son las leyes generales existentes en Ecuador para el desarrollo y aplicación de este principio. Todo esto con el fin de constatar el alcance del Iura Novit Curia en materia laboral y, cómo éste se está aplicando en la actualidad para proteger los derechos de las personas y precautelar la tutela judicial efectiva y seguridad jurídica como deber del Estado.Palabras clave: Derecho Laboral, garantía, Iura Novit Curia, justicia, principio AbstractThe principle of Iura Novit Curia is one of the fundamental principles within procedural law that are currently applied, since its meaning is relevant when saying: "the judge knows the law". This principle is based on the application made by the administrator of justice of the rules that have not necessarily been invoked by the procedural parties in terms of the events exposed, but that the judge needs to apply a normative content that allows him to motivate and support his decision. The general objective of this article is to perform a critical-legal analysis of the principle of Iura Novit Curia in labor matters, which is regulated within the Ecuadorian legal system and has international relevance. In order to know the investigative result, the qualitative methodology has been used with methods such as the historical-logical, determining the real trajectory of the principle of iura novit curia and which are the existing general laws in Ecuador for the development and application of this principle. All this in order to verify the scope of Iura Novit Curia in labor matters and how it is currently being applied to protect the rights of individuals and to safeguard effective judicial protection and legal certainty as a duty of the State.Keywords: labor law, guarantee, Iura Novit Curia, justice, principle
