SUMMARY
ResumenEste trabajo trata del derecho a llevar símbolos religiosos. Para lograr este objetivo, se analiza, en primer lugar, el significado de los símbolos religiosos distinguiendo los diferentes espacios públicos donde las personas los portan. En segundo lugar, el trabajo examina el margen de apreciación que tienen los Estados miembros del Consejo de Europa y lo compara con el control de convencionalidad de la jurisprudencia de la Corte Interamericana de Derechos Humanos. En tercer lugar, estudia la jurisprudencia del Tribunal europeo de Derechos Humanos y la del Tribunal de Justicia de la Unión Europea sobre esta materia. Además, contiene una breve referencia a la jurisprudencia de la Corte Interamericana de Derechos Humanos y a la de algún tribunal estatal. En cuarto lugar, contempla el derecho y la jurisprudencia española sobre los mencionados símbolos. To achieve this objective, the meaning of religious symbols is first analysed, distinguishing the different public spaces where people carry them. Secondly, the margin of appreciation enjoyed by the member States of the Council of Europe is studied and compared with the control of the conventionality of the case law of the Inter-American Court of Human Rights. Thirdly, this paper examines the case law of the European Court of Human Rights and that of the Court of Justice of the European Union on this matter. In addition, it contains a brief description of the case law of the Inter-American Court of Human Rights and of some of a State court. Fourth, the Spanish law and case law on the mentioned symbols is considered.
