ResumoO Supremo Tribunal Federal brasileiro recentemente laní§ou um importante precedente em matéria de liberdade religiosa, decidindo trancar aí§í£o penal em curso movida contra sacerdote da Igreja Católica que, em livro de sua autoria, publicou afirmaí§íµes discriminatórias contra a doutrina espírita e religiíµes de matriz africana. A argumentaí§í£o do ministro relator, traí§ando as linhas que separam o proselitismo de religiíµes com pretensíµes universalistas e o racismo condenado pela lei penal, certamente servirá de precedente para futuros casos envolvendo conflitos entre diferentes posturas religiosas no país. O presente artigo se propíµe a apresentar o caso í comunidade acadíªmica latino-americana e analisar a linha teórica seguida pela decisí£o.Palavras-Chave: Discurso de ódio – discriminaí§í£o religiosa – proselitismo – crime de racismo – jurisprudíªncia do stf – liberdade religiosa – liberdade de expressí£o.AbstractThe Brazilian Federal Supreme Court has recently set an important precedent in terms of religious freedom, deciding to halt a criminal lawsuit filed against a priest of the Catholic Church who published a book containing several discriminatory remarks against the spiritist doctrine as well as against religions of African origin. The arguments set forth by the reporting judge, defining the lines that separate the proselytism of religions with universalist claims from racism forbidden by criminal law, will certainly serve as a precedent for future cases involving conflicts between different religious practices in the country. This article aims to present the case to the Latin American academic community and to analyze the theoretical lines followed by the decision.
