No entanto, ao estudar a engenharia urbanística e financeira adotada, o artigo mostra que há uma deturpação manifesta do instrumento da outorga onerosa do direito de construir. Se o problema inicial da aprovação do Estatuto da Cidade era a falta de eficácia dos seus instrumentos jurídicos, seu desafio atual é lutar contra a apropriação destes pelo mercado imobiliário para finalidades exclusivamente mercantis. Palavras-chave: outorga onerosa do direito de construir, planejamento urbano, sistemática urbanística, ilegalidade ABSTRACT For the reform works in the (private) Stadium Joaquim Américo in Curitiba - “Arena da Baixada”, where some of the games of Word Cup FIFA 2014 will take place, the municipality had adopted a financing strategy by using constructive potential titles. However, after studying the urban and financial engineering adopted, the article shows a clear perversion of the instrument “onerous grant of building right”. If the initial problem in Brazilian judicial system, after the approval of the law called City Statute, was the lack of effectiveness of its legal instruments. The challenge today is to fight against the appropriation of its urban instruments for commercial purposes only.
