RELASI HUKUM ISLAM, ADAT DAN HUKUM NEGARA DALAM PERKAWINAN MASYARAKAT SUKU MELAYU DI PEKANBARU RIAU: KEABSAHAN, ETIKA, DAN ADMINISTRASI PERKAWINAN (ISLAMIC LAW, ADAT, AND STATE LAW RELATION IN THE MARRIAGE PRACTICE AMONG MALAY PEOPLE IN PEKANBARU RIAU: LEGALIZATION, ETHICS AND ADMINISTRATION)

SUMMARY

The purpose of this article was to explore the practice of marriage in Pekanbaru, Riau. This essay contended that marriage customs among Malay people in Pekanbaru involved three systems of law, namely Islamic law, adat, and state law. Focusing on the subject of legal plurality, This article suggested that these three legal systems have a functional relationship. Islamic law is used to determine whether or not a marriage is legal. The function of customary law is to control the marriage procession sequence. Meanwhile, state law governs the administrative and procedural aspects of marriage. Keywords:Functional Relation, Customary Marriage, Islamic Law, State Law AbstrakArtikel ini membahas tentang praktik upacara perkawinan yang terjadi pada masyarakat Melayu Pekanbaru Riau. Dengan mendasarkan pada konsep pluralisme hukum, tulisan ini menyimpulkan bahwa terdapat tiga sistem hukum yang berlaku dalam praktik perkawinan pada masyarakat Melayu, yaitu hukum Islam, adat, dan hukum negara. Masing-masing sistem hukum ini mempunyai perananan yang saling melengkapi antara satu dengan yang lainnya. Hukum Islam berperan penting dalam menentukan keabsahan perkawinan yang dilakukan. Adat berperan penting dalam mengatur tata cara dan prosedur dalam prosesi perkawinan. Sedangkan hukum negara mempunyai fungsi administratif perkawinan.
