DIREITOS HUMANOS E GÊNERO PARA ALÉM DOS DIREITOS DAS MULHERES: NAÇÕES UNIDAS E DIREITOS LGBTQI+

Resumo

Objetivos: Analisar a pauta de gênero da agenda mundial de direitos humanos universais, com ênfase nos direitos LGBTQI+.

Metodologia: Pesquisa dedutiva, cuja hipótese será desenvolvida mediante interpretação linguística crítica. Inclui a contextualização da problemática do reconhecimento naturalista de direitos das mulheres como pauta da política de gênero internacional; ainda, a problematização da exclusão da população LGBTQI+ da política de gênero, principalmente a necessidade do reconhecimento público e internacional dos direitos plurais de gênero e sexualidade em prol de um projeto democrático radical de direitos humanos universais.

Resultados: A estrutura político-jurídica de direitos humanos, de caráter filosófico racionalista e universalista, estrutura-se a partir de uma concepção binária do sistema sexo-gênero. Essa estrutura concede importância para a igualdade entre homens e mulheres, mas exclui da proteção universal pessoas cujo gênero ou sexualidade sejam dissidentes do dispositivo compulsório de gênero ou sexualidade. Com isso, existe uma ausência da proteção legal das pessoas LGBTQI+ por parte das Nações Unidas, de caráter vinculativo aos Estados-membros, apesar de levantamentos oficiais demonstrarem que grande parte das violações de direitos e violências são cometidas por Estados.

Contribuição: A pesquisa justifica-se em razão da ausência de um tratado internacional de direitos humanos que proteja a população LGBTQI+, além da massiva violação de direitos LGBTQI+ a nível mundial. Contribui por realizar uma análise filosófica sobre os fundamentos dos direitos humanos, como explicação à exclusão das pessoas LGBTQI+ da proteção internacional, assim como contribui por sinalizar o vácuo em tratados protetivos e a necessidade urgente de um projeto democrático radical de direitos humanos.

ABSTRACT

Objectives: The objective is to analyze the gender agenda of the global universal human rights schedule, with an emphasis on LGBTQI + rights.

Methodology: Deductive research, whose hypothesis will be developed through critical linguistic interpretation. It includes the contextualization of the problem of naturalistic recognition of women's rights as an agenda of international gender policy; still, problematizing the exclusion of the LGBTQI + population from gender policy, mainly the need for public and international recognition of plural rights of gender and sexuality in favor of a radical democratic project of universal human rights.

Results: The political-legal structure of human rights, of a rationalist and universalist philosophical character, is structured from a binary conception of the sex-gender system. This structure gives importance to equality between men and women but excludes from universal protection people whose gender or sexuality are dissidents from the compulsory device of gender or sexuality. As a result, there is an absence of legal protection for LGBTQI + people by the United Nations, which is binding on Member States, although official surveys show that a large part of the violations of rights and violence are committed by States.

Contribution: The research is justified due to the absence of an international human rights treaty that protects the LGBTQI + population, in addition to the massive violation of LGBTQI + rights worldwide. It contributes by carrying out a philosophical analysis on the foundations of human rights, as an explanation of the exclusion of LGBTQI + people from international protection, as well as contributing to signal the vacuum in protective treaties and the urgent need for a radical democratic human rights project.
