DOI: 10.12957/rdc.2018.29866 A insustentabilidade da gestão do espaço urbano demanda abordagem não restrita ao plano teórico, mas amparada pela percepção do cotidiano, como tratado pela ciência jurídica. O objetivo deste artigo é apresentar as soluções existentes no arcabouço jurídico para os problemas urbanos, sabendo que a construção de cidades sustentáveis preocupa, especificamente, cientistas sociais e gestores públicos. A fim de transcender o conceito de “cidades sustentáveis” e “sustentabilidade urbana” o problema que orienta esta exposição é: Quais instrumentos urbanístico-ambientais, previstos na legislação brasileira, são juridicamente viáveis para a estruturação de cidades sustentáveis? O método de análise é o dedutivo, elegendo-se como premissa a legislação existente sobre cidades sustentáveis e, especificamente, os dispositivos constitucionais da Política Urbana, regulamentados pela Lei n. 10.257 de 2001. A fundamentação desta investigação é baseada na Teoria da Justiça de Amartya Sen e a ‘Encíclica Laudato Si’. Palavras-chave: Cidades Sustentáveis; Estatuto da Cidade; Política Urbana; Sustentabilidade Urbana Abstract The unsustainability of the management of urban space demands an approach not restricted to the theoretical plane, but supported by the perception of daily life, as treated by legal science. The objective of this article is to present the solutions existing in the legal framework for urban problems, knowing that the construction of sustainable cities specifically concerns social scientists and public managers. In order to transcend the concept of "sustainable cities" and "urban sustainability", the problem that guides this exhibition is: Which urban-environmental instruments, provided for in Brazilian legislation, are legally viable for the structuring of sustainable cities? The method of analysis is the deductive one, being chosen as premise the existing legislation on sustainable cities and, specifically, the constitutional provisions of the Urban Policy, regulated by Law n. 10,257 of 2001. The basis of this investigation is based on the Theory of Justice of Amartya Sen and the 'Encyclical Laudato Si'.
